Terms & Conditions
Any Internet user, physical person, visiting the site www.aquacycle.be or purchasing a product from Aquacycle SRL is referred to in these Terms and Conditions as the "Customer".
Any order for a product offered on the site implies prior consultation and therefore express acceptance by the Customer of these General Terms and Conditions of Sale.
All orders placed on the site are subject to these General Terms and Conditions of Sale. Aquacycle SRL reserves the right to adapt or modify the present Terms and Conditions at any time. The version of the Terms and Conditions applicable to any transaction is the one appearing online on the site at the time the order is placed.
Validation of the order form is treated as an electronic signature having, between the parties, the same value as a manual signature and serves as proof of the completeness of the order and of the payability of the sums due in execution of the said order.
The sales contract may be concluded in French, Dutch or English, at the Customer's discretion.
Article 1 - Scope of application
These Terms and Conditions define the rights and obligations of the parties arising from the online sale of products offered on the site. www.aquacycle.be owned by Aquacycle SRL.
These Terms and Conditions apply to all sales of products made through the website and supersede all other terms and conditions issued by Aquacycle SRL or the Customer. Aquacycle SRL must give its express prior written consent to any deviation from these Conditions.
Article 2 - Legal capacity and acceptance
The Customer declares that he/she is a natural person of legal age and capacity. A person declared incapable cannot purchase products on the Aquacycle SRL website - and therefore cannot be a Customer - and must make purchases through his/her legal representative.
All orders placed on the site www.aquacycle.be therefore implies the customer's unreserved acceptance of these conditions.
In addition, the Customer explicitly accepts the present General Terms and Conditions of Sale by clicking on a box or ticking a box next to the wording ("I accept the General Terms and Conditions of Sale").
The present General Terms and Conditions of Sale are permanently accessible at the following address: www.aquacycle.be in a format that can be printed. Each customer is therefore offered the possibility of saving and/or printing them.
Article 3 - Products
The Products offered by Aquacycle SRL are those presented on the site at the time the Customer places his/her order, within the limits of their availability.
Aquacycle SRL undertakes to make every effort to deliver all orders.
Notwithstanding this, Aquacycle SRL cannot be held responsible for the unavailability of a Product, nor for any damage that may result therefrom. If one or more Products in an order are unavailable, Aquacycle SRL will inform the Customer by e-mail that the order has been fully or partially cancelled or split.
In the event that unavailability is discovered and communicated at a time when the Customer has already paid for the Products, Aquacycle SRL will immediately ask its bank to refund the amounts paid. The Customer will be notified by e-mail. The speed at which the refund is processed depends on the payment method used by the Customer to make the purchase. If the purchase was made by credit card, the refund will appear on the first subsequent monthly credit card statement. If the Customer feels that the refund is taking too long, he is advised to contact his bank.
In any case, Aquacycle SRL will make the refund within 30 working days.
All Products offered for sale on the Site are described as accurately as possible to the best of our knowledge and belief.
Article 4 - Prices and invoicing
Prices are those shown on the site at the time the order is placed. Prices are indicated in euros, including VAT. The VAT rate applicable is that in force in the country of origin, i.e. Belgium, regardless of the country of destination.
For deliveries in Belgium, delivery costs are included in the price, VAT included.
For deliveries outside Belgium, product prices do not include delivery charges. These costs will be billed to the customer in addition to the purchase price. If the customer has been granted a discount, this will be deducted from the price separately.
For Switzerland and all other countries outside the European Union, the sales prices displayed are deemed to be exclusive of VAT and therefore cannot be subject to VAT deduction. The Customer acknowledges that he/she is considered the official importer and that, depending on the country of delivery chosen at the time of ordering, he/she may be required to pay customs and/or import duties in accordance with the legislation in force in said country.
Aquacycle SRL reserves the right to modify sales prices and delivery charges at any time. However, products and charges will always be invoiced on the basis of the rates in force at the time the order is registered, provided that these products are available.
The Customer consents to Aquacycle SRL transmitting the invoice in electronic form.
Products remain the property of Aquacycle SRL until full payment has been received from the Customer, i.e. full payment of the purchase price and delivery charges.
Article 5 - Payment methods
Payment in full must be made online by Visa, Mastercard or Bancontact (in Belgium) at the time of ordering. No COD shipments will be accepted for any reason whatsoever.
The communication by the Customer of his/her credit card number constitutes authorization for Aquacycle SRL to debit his/her account for the amount of the order. The Customer's credit card will be debited once the purchase has been confirmed, and payment will only be effective once the Customer's bank has given its approval to Aquacycle SRL. If the latter refuses payment, the order is automatically refused.
The Customer warrants that he/she is entitled to make online payments using one of the above-mentioned payment methods and that the bank account linked to the credit card or Bancontact offers sufficient cover to meet all costs generated by the transaction. Failing this, Aquacycle SRL may refuse the order.
Purchases are made securely. Aquacycle SRL works with a payment platform (hereinafter referred to as the "Payment Provider") to process online payments. The Payment Provider provides a secure payment system. This system is independent of Aquacycle SRL, which is not and cannot be held responsible for its operation. All information communicated at the time of payment is strictly protected and guarantees the conformity and security of each transaction. Aquacycle SRL has no access to this confidential data, nor does it record it.
The data recorded and kept by Aquacycle SRL constitutes proof of the order and of all transactions. The data recorded by the payment system constitutes proof of financial transactions.
Aquacycle SRL reserves the right to refuse any order from a Customer with whom a dispute is in progress or with whom a dispute has previously arisen. Aquacycle SRL may also refuse an order in the event of non-payment or incomplete payment of a previous order.
Article 6 - Ordering Products
Notwithstanding any proof that the Customer may have, it is explicitly agreed that only the data recorded in the computer system of Aquacycle SRL, its hosting partner or the Payment Provider provide proof of the communication and content of the order, as well as all transactions that have taken place between the Parties.
Orders placed on the site are subject to compliance with the procedure established by Aquacycle SRL, which consists of a succession of different stages that the customer must follow in order to validate the order. Before confirming the order, the customer will have the opportunity to check the details of the order and its total price, and to correct any errors, before confirming the order to express his/her acceptance. Any order confirmed by the customer constitutes a sales contract and acceptance of all the stipulations herein.
To validate an order, customers must register on the site - if they do not already have an account - and choose a delivery and payment method. The total amount to be paid is clearly displayed throughout the checkout process. The order becomes final and cannot be modified once payment has been made.
When registering the Customer's personal data in the "My FD" section, the Customer must ensure the accuracy and completeness of the mandatory data provided. In the event of an error in the recipient's details, Aquacycle SRL cannot be held responsible for the impossibility of delivering the product.
A confirmation email summarizing the order (products, price, product availability, quantity, etc.) will be sent to the Customer. To this end, the Customer formally accepts the use of electronic mail for confirmation by Aquacycle SRL of the contents of his/her order.
Failure by any person to comply with the obligations subscribed to under the terms of these General Terms and Conditions of Sale, and in particular concerning any incident of payment of the price of an order, may result in the suspension of access to the service of www.aquacycle.beAquacycle SRL reserves the right to refuse any order from a person with whom such a dispute exists. Consequently, Aquacycle SRL reserves the right to refuse any order from a person with whom such a dispute exists.
All contractual information relating to the order is communicated to the customer in the language chosen at the time of registration, when the order is confirmed.
Article 7 - Deliveries
When the order is confirmed, the Customer is asked to specify a specific address (home, workplace or other) for delivery. Delivery is made to the delivery address indicated by the Customer, it being specified that this must be the Customer's home address, place of work or the address of any other natural person of the Customer's choice. Delivery cannot be made to post office boxes.
In order to meet the delivery deadline, the customer must ensure that he has provided accurate and complete information concerning the delivery address (such as, in particular: street number, building number, staircase number, access codes, intercom names and/or numbers, etc.).
Delivery will be made by a service provider (hereinafter referred to as the "Delivery Service Provider") selected by Aquacycle SRL. Aquacycle SRL cannot be held responsible for the delivery process or the delivery time once the Product has left its premises. In the event of loss, the Customer should contact the Delivery Service Provider.
Delivery times are given as an indication and correspond to average processing and delivery times. Aquacycle SRL undertakes to inform the Customer of the progress of its order processing. No delay in delivery may give rise tò termination by the purchaser of the sales contract or payment of damages on our part.
Upon delivery, the Customer is required to carefully examine the merchandise received and to mention in writing any problems noted on the Delivery Provider's delivery slip. In the absence of such a written statement, the Customer is expressly deemed́ to have accepted́ the goods in the condition and quantitý delivered and exonerates us from any liabilitý in this respect.
If the Customer does not receive the delivery within the possibilities offered by the Delivery Provider and the order is returned to Aquacycle SRL, we will contact the Customer by email in order to schedule a new delivery of the order. Additional costs may be charged to the customer. In the absence of a response from the Customer or receipt of this new delivery, the order will be considered as fully executed without Aquacycle SRL being obliged to make any reimbursement.
The Products ordered are delivered to the delivery address indicated by the Customer during the order process and in accordance with the conditions described therein.
Orders can be delivered worldwide. However, Aquacycle SRL reserves the right to refuse delivery to a particular country and/or to a country where the Delivery Provider does not ensure delivery. In this case, the Customer will be asked to provide a delivery address in another country. Should the Customer be unable to provide an alternative address, Aquacycle SRL will cancel and refund the order for inability to deliver, without the Customer being entitled to claim any compensation whatsoever.
Aquacycle SRL reserves the right to split the order into one or more deliveries, depending on the availability of the Products. Each delivery will be announced by e-mail. The delivery will be accompanied by an order form on which, among other things, the details of the goods delivered will appear.
Article 8 - Right of withdrawal and return policy
Unless otherwise stated on the site, the Customer, if a private individual, has a right of withdrawal of 14 days. Within 14 calendar days from the day following receipt of the package, the Customer must inform Aquacycle SRL of his intention to exercise his right of withdrawal.
Customers may exercise their right of withdrawal and request a return by e-mail to info@aquacycle.testing.8trust.com.
All returns must be requested in advance. The date of submission of the form is decisive for the 14-day withdrawal period.
The right of withdrawal for delivered Products only applies if the Product :
The Product subject to retraction must be returned in the state in which it was delivered, accompanied by the original sales invoice (a copy of which will be retained by the Customer). Any returns for which the sender cannot be identified, or which do not comply with the defined return conditions, will be refused.
Once the aforementioned period of 7 calendar days has expired, Aquacycle SRL will no longer be able to accept the return, which will be sent back to the sender at his expense. The return must be sent to the following address, also clearly stipulated on the return document:

All returns are made at the Customer's expense and risk.
Aquacycle SRL reserves the right to offer the Customer an exchange or adaptation of the product purchased. If the Customer does not accept Aquacycle SRL's proposal, the purchase will be reimbursed within 30 calendar days of Aquacycle SRL's receipt of the return in due time, provided that all the conditions described above have been strictly complied with. The amount refunded will never exceed the amount actually paid by the Customer for the Product.
If the Customer has paid for the order using a credit card, a credit will be granted to the credit card used by the Customer to pay for the purchase price of the returned items, after checking the items and deducting any sums due or vouchers or discounts used to pay for the order. The Customer will be reimbursed in accordance with the terms and conditions agreed with the bank issuing the card.
Article 9 - Warranties
9.1. Legal warranties
Aquacycle SRL guarantees that the products offered for sale do not have any visible or invisible defect that would prevent the use of the Product or make it dangerous.
Customers may contact Customer Service via the form on the Site for any questions relating to the product purchased.
9.2 Conformity warranties
The Vendor is liable for defects in conformity existing at the time of delivery of the Product as described on the site.
The Vendor invites the Buyer to report any lack of conformity immediately upon delivery and as soon as possible, by contacting customer service and providing the following information:
-order number
-last name, first name and address
-reference of the item(s) to be returned
-reason(s) for non-conformity return
The Seller will provide the customer with a reference number and the procedure to follow to ensure optimum management of returned goods.
The photographs of the Products on the Site are as accurate as possible, but cannot guarantee perfect similarity with the Products, particularly as regards colors. Users and Buyers therefore exonerate the Vendor from any claim in this respect in the event of an insubstantial difference between the Products and their photographic representation on the Site, provided that this does not alter the essential qualities of the Products.
In the event of a lack of conformity, the Buyer chooses between reimbursement of the Product and repair within 30 days, or replacement of the Product. However, the Vendor may not proceed according to the Purchaser's choice if this choice entails a cost that is manifestly disproportionate to the other option, given the value of the Product or the extent of the lack of conformity. The Vendor is then obliged to proceed, unless this is impossible, according to the method not chosen by the Buyer. If, in the event of a major defect, repair or replacement of the Product is impossible, the Buyer may return the Product and have the price refunded within 30 days. The Buyer acknowledges that the conformity warranty does not apply in the event of excessive use in relation to normal use.
9.3. Warranties for hidden defects
All Products offered for sale on the Site are covered by the legal warranty against hidden defects stipulated in articles 1641 et seq. of the French Civil Code. The Buyer has a statutory period of two years from the date of discovery of the hidden defect in which to take legal action. This defect must render the Product unfit for the use for which it was intended, or so diminish this use that the Buyer would not have purchased it, or would only have paid a lesser price for it, had he known of it. The Vendor is not liable for any apparent defects in the Products of which the Buyer has been able to convince himself. The Vendor reserves the right to refuse any request for reimbursement that is manifestly abusive or made outside the prescribed time limits.
9.4. Manufacturer warranties
The Manufacturer's warranty does not preclude the application of the legal warranty. The period of validity may vary according to the Manufacturer. The Buyer must verify that the warranty has been honored upon delivery of the Product. Conditions of validity of warranties The Purchaser is aware that these Products are sold for normal consumer use and are not intended for professional use. The Buyer must use the product with due care and attention to the product's storage conditions (heat, humidity, no overheating, etc.). In the event of non-compliance with the above recommendations, the Vendor will be exonerated from all liability. The burden of proof of compliance with the recommendations lies with the Buyer.
9.5. Guarantees do not cover :
- Damage due to an external cause or to the intervention of a repairer who has not been previously approved by the Vendor or the Manufacturer.
- Normal wear and tear of the Products.
With the exception of a return of the Product for lack of conformity, the costs and risks associated with the return are borne by the Buyer.
The Vendor will take care to limit the length of downtime of the Product which may be attributable to the constraints of the Manufacturers.
Article 10 - Liability
Aquacycle SRL cannot be held responsible for any direct or indirect damage (interruption of operations, loss of earnings, loss of opportunities, etc.) resulting from the use or unavailability of the site.
Aquacycle SRL is also not responsible for any damage caused to the Customer's systems as a result of visiting the site, such as the presence of Trojan horses from outside sources or computer viruses.
Aquacycle SRL cannot be held responsible for any errors in the photos or text used to describe the Products on the Sites.
Aquacycle SRL cannot be held responsible for the impossibility of delivering orders due to the exhaustion of stock or for reasons beyond its control, including cases of force majeure, such as disruption or stoppage of transport, postal or communication services, flood or fire, or inconvenience or damage inherent in the use of the network.
In all cases where Aquacycle SRL is or may be held liable, its liability shall be limited to the amount actually paid by the Customer for the order concerned.
Article 11 - Disputes and applicable legislation
All orders automatically imply the customer's acceptance of the general sales conditions. These terms and conditions are governed by Belgian law. The courts of the judicial district of Brussels shall have exclusive jurisdiction to settle any dispute arising between the parties in connection with the contract.

Article 13 - Modification of the General Terms and Conditions of Sale and Invalidity
Aquacycle SRL may modify these General Terms and Conditions of Sale at any time, inter alia to comply with legal requirements. Modifications communicated via the website will take effect for all subsequent offers or orders.
Aquacycle SRL reserves the right to modify the concept and content of its website at any time. Customers have the right to deactivate their account following a modification of the General Terms and Conditions.
Should one or more articles of these General Terms and Conditions be declared invalid or unenforceable by a court decision, such decision shall have no effect on the validity and enforceability of the remaining articles and paragraphs of these General Terms and Conditions and of the contract between the parties.
Le site www.aquacycle.be (the "Site") is an online sales site for filtration and water treatment products (the "Product") belonging to AQUACYCLE SRL, whose registered office is at 1rue de Tourinnes, 1325 Chaumont-Gistoux, Belgium (hereinafter referred to as "AQUACYCLE").Aquacycle").
Access to the Site and use of its content are subject to the terms of use described below. By accessing and browsing the Site, the Internet user (the "Internet User" or "You") constitutes unreserved acceptance of the following details.
Article 14 - Intellectual property rights
